Acceptance of Terms
By downloading or using Kokyu, you agree to these Terms of Service. If you disagree with any part of these terms, you may not access the Service. You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.
Description of Service
Kokyu is a diver companion and breath training app that helps you practice breath holds, CO2/O2 tolerance training, box breathing, and other breathing exercises. Kokyu is provided by Kubicle LLC.
Health Disclaimer
Kokyu is designed as a training aid and is not a medical device. The app does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before beginning any breath training program. Never practice breath holds in or near water without proper supervision. Kubicle LLC is not liable for any injury or harm resulting from the use of this app.
Privacy Policy
Your access to and use of the Service is also conditioned on your acceptance of and compliance with our Privacy Policy. Please read our Privacy Policy carefully before using our Service.
User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Use of the App
You are solely responsible for your use of the Service. You agree not to use the app to engage in any activity that violates applicable laws or regulations, or to harass, abuse, or harm other users.
Intellectual Property
All rights, title, and interest in Kokyu, including its design, code, content, and branding, are owned by Kubicle LLC. You may not copy, modify, distribute, or reverse-engineer any part of the app.
User Content
Training sessions and data you create within Kokyu remain yours. By setting sessions to public or friends visibility, you grant us a non-exclusive license to display that content to the selected audience within the app.
Termination
We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
No Warranty
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. Kubicle LLC does not guarantee that the app will be error-free, uninterrupted, or suitable for any particular purpose.
Limitation of Liability
To the fullest extent permitted by law, Kubicle LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Kokyu, including but not limited to physical injury, data loss, or service interruptions.
Governing Law
These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law provisions.
Changes to These Terms
We may update these terms from time to time. Continued use of the app after changes constitutes acceptance of the revised terms.
