Acceptance of Terms
By downloading or using Atoma, you agree to these Terms of Service. If you disagree with any part of these terms, you may not access the Service. You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.
Description of Service
Atoma is a health intelligence app that reads your Apple HealthKit data and displays it in a unified, multi-platform dashboard. Atoma provides visualizations, trends, and statistics of your health metrics. Atoma is provided by Kubicle LLC.
Health Disclaimer
Atoma is an informational tool and is not a medical device. The app does not provide medical advice, diagnosis, or treatment recommendations. Health data displayed in Atoma is sourced from Apple HealthKit and is presented as-is for informational purposes only. Always consult a qualified healthcare professional for medical decisions. Kubicle LLC is not liable for any decisions made based on data displayed in the app.
Privacy Policy
Your access to and use of the Service is also conditioned on your acceptance of and compliance with our Privacy Policy. Please read our Privacy Policy carefully before using our Service.
HealthKit Data
Atoma accesses your HealthKit data with your explicit permission. You can control which data types Atoma can read through the Apple Health app at any time. Atoma reads HealthKit data in a read-only capacity and does not write data to HealthKit.
Use of the App
You are solely responsible for your use of the Service. You agree not to use the app to engage in any activity that violates applicable laws or regulations, or to reverse-engineer, decompile, or disassemble any part of the app.
Intellectual Property
All rights, title, and interest in Atoma, including its design, code, content, and branding, are owned by Kubicle LLC. You may not copy, modify, distribute, or reverse-engineer any part of the app.
User Content
Annotations, notes, and preferences you create within Atoma are stored in your private iCloud account and remain yours. Kubicle LLC does not access or use your CloudKit data.
Termination
We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
No Warranty
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. Kubicle LLC does not guarantee that the app will be error-free, uninterrupted, or that health data will be accurate or complete.
Limitation of Liability
To the fullest extent permitted by law, Kubicle LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Atoma, including but not limited to decisions made based on health data, data loss, or service interruptions.
Governing Law
These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law provisions.
Changes to These Terms
We may update these terms from time to time. Continued use of the app after changes constitutes acceptance of the revised terms.
